Who filed an action? Who was the action filed against? When was the action filed? What did NY city issue? What is ordinance? What does the ordinance regulate? Would it fall within the scope of assessment of the Public Defender of Rights? (Self governing body x representative of state power) What is the Airbnb company alleging? The company says the ordinance, which comes into effect in July, imposes arbitrary excessive restrictions that would greatly reduce the number of people who can host rentals in the city.  The owners are afraid of long term rentals as it is impossible or very difficult to get rid of long term tenants. (Terminate the tenancy / long long term rental contract can be very hard.) Do you think that the law is overprotective in favour of long term tenants? It would require owners to register the short term rental with the mayor’s office, disclose who else lives in the property, and promise to comply with zoning requirements, (residential - it is not tourism and recreational) construction and maintenance ordinances. Airbnb said called the restrictions “extreme and oppressive” and a de facto ban against short-term rentals that left the company no choice but to sue. “Taken together, these features of the registration scheme appear intended to drive the short-term rental trade out of New York City once and for all,” Airbnb said. The company claims the restriction is unconstitutionally limiting property rights of property owners and is excessive (disproportionate)
